Smart Play or Foul?

This play always annoys me when watching basketball, when a player beats there man and is going in for a layup but knows he's going to get blocked from behind, he'll jump backwards into the guy to create space and make the basket plus the foul.

I see Billups and Andre Miller do this all the time and to me it's an offensive foul, so is it a foul or a smart play?

If they get away with it all the time that makes it a smart play, doesn't it?

In essence it's a smart play because they never call it but im saying should they call it.

are both players moving

are both players moving because if both players are moving most times the offense will get the benifit of the call.
